By purchasing, downloading, or subscribing to any product or service, you (“Client,” “You”) agree to be bound by these Terms & Conditions with AI Marketing Edge Ltd (“Company,” “we,” “us”).

1. Program & Services

AI Marketing Edge Ltd provides guides, templates, training, consulting, and membership-based access to CustomGPTs and other digital resources (“Program”).

As part of the Program, you may receive access to:

A password-protected membership area containing lessons, templates, worksheets, and other materials;

CustomGPTs and AI-powered tools accessible via subscription;

Bonuses and offers available at the time of your enrolment.

Access to the membership area is provided for as long as the Program exists, but no less than 120 days. If the Company intends to close the Program Area, 30 days’ notice will be given with the ability to download resources.

2. Membership & GPT Use

Memberships grant you a limited, non-exclusive, non-transferable license to access CustomGPTs and related resources for your own business or personal use.

You may not share, resell, sublicense, or distribute membership access, CustomGPTs, or related materials without written consent.

AI Marketing Edge may suspend or revoke membership access if accounts are misused, access is shared, or tools are used unlawfully.

All responsibility for reviewing, editing, and approving AI-generated outputs before use lies with the Client.

3. Disclaimer

The Company’s Privacy Policy, Terms of Use, and Website Disclaimer are incorporated by reference into this Agreement.

Client understands that AI Marketing Edge Ltd is not an employee, agent, lawyer, doctor, therapist, financial advisor, accountant, or publicist. Specifically, the Company does not:

Guarantee sales, business results, or employment;

Provide tax, accounting, or legal advice;

Provide medical, therapeutic, or dietary advice;

Act as a publicist to secure press coverage or interviews;

Introduce Clients to its private network of partners or affiliates.

If the parties wish to continue their relationship beyond the scope of the Program, a separate agreement must be entered into.

4. AI Disclaimer

Some deliverables and products (including CustomGPTs, templates, and training) use AI assistance. You acknowledge that:

AI outputs may contain inaccuracies, bias, or errors;

AI Marketing Edge Ltd does not warrant that outputs will be accurate, compliant, or fit for a particular purpose;

Technologies evolve quickly and may change without notice, affecting functionality;

You are solely responsible for reviewing, editing, and approving all outputs before publication or reliance;

AI Marketing Edge is not liable for damages, reputational harm, or compliance issues resulting from AI-generated outputs.

5. Data & Privacy

You are responsible for ensuring that data or prompts you input into CustomGPTs do not contain sensitive personal information, confidential data, or unlawful content.

AI Marketing Edge cannot guarantee the confidentiality of any data submitted through third-party AI platforms.

6. Fees & Payment

Fees are payable either as a one-time payment or via an agreed payment plan.

If you select a payment plan, you authorize recurring charges to your chosen payment method until the balance is complete.

Failure to complete payments may result in suspension or termination of access.

7. Refund Policy

Courses, templates & GPT memberships include a 30-day conditional money-back guarantee. To request a refund, you must email support ([email protected]) within 30 days of purchase and provide evidence of participation (e.g. completed coursework or reasonable use).

Refunds will not be granted after the 30-day period.

After 30 days, all payments are non-refundable, and you remain responsible for completing your payment plan.

This policy does not override your rights under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986.

Membership Cancellations: If you cancel your membership, you will continue to have access until the end of your current billing cycle. After that date, your access will automatically end and no further charges will apply.

If a refund is issued, all licenses to use materials and membership access will immediately terminate, and you must delete/destroy all copies of Program resources.

Training Terms & Conditions: By registering for this training, you agree that all sales are final due to the digital and live nature of the program.

Replay access will be provided for a minimum of 90 days unless otherwise specified.

All materials are copyright of AI Marketing Edge Ltd and may not be shared, resold, or redistributed.

We make no guarantees of specific results, earnings, or outcomes.

Participation is contingent upon respectful conduct within any private groups or sessions.

AI Marketing Edge Ltd is not responsible for technical issues outside our control (e.g. internet connectivity).

8. Confidentiality

You agree not to share proprietary Company methods, templates, or Program materials outside of permitted use. You also agree to respect the confidentiality of other Program participants.

9. Intellectual Property

All content, including text, templates, logos, training materials, frameworks, and CustomGPT configurations, is the property of AI Marketing Edge Ltd or its suppliers.

Your license is limited to individual use. You may not copy, resell, distribute, or reverse engineer our content. Any violation results in immediate termination of access without refund.

10. Independent Contractor Status

Participation in the Program does not create a partnership, employment, or agency relationship.

11. Limitation of Liability

To the maximum extent permitted by law:

AI Marketing Edge Ltd’s total liability shall not exceed the fees paid by the Client.

We are not liable for indirect, incidental, special, or consequential damages, including lost profits or reputational harm.

If you are dissatisfied with the Program, your sole remedy is to discontinue use.

12. Indemnification

You agree to indemnify and hold harmless AI Marketing Edge Ltd, its directors, officers, employees, and contractors from any claims, damages, or expenses arising from your misuse of the Program, AI tools, or violation of these Terms.

13. Termination

The Company reserves the right to terminate your access without refund if you breach these Terms, misuse membership access, or engage in disruptive behaviour.

14. Force Majeure

The Company is not liable for failure to perform due to events beyond reasonable control (including natural disasters, technical failures, or government actions).

15. Dispute Resolution & Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved exclusively in the courts of New Zealand.

16. Non-Disparagement

You agree not to make defamatory, false, or disparaging statements about AI Marketing Edge Ltd or its staff.

17. Modifications

We may update these Terms at any time by posting on our Website. Continued use of our products or services constitutes acceptance of the updated Terms.

18. Earnings Disclaimer

AI Marketing Edge Ltd makes no guarantees about earnings or business outcomes from using our products, services, or AI tools. Results vary depending on your own skills, effort, market conditions, and business model.

Testimonials are individual experiences and not typical. AI Marketing Edge Ltd does not offer “get rich quick” programs.
